Commercial Litigation
LTT represents some of the largest corporations in the United States in complex commercial litigation relating to contracts, business torts, fraud, bankruptcy, construction, franchise disputes, securities litigation, and trade secrets. LTT’s attorneys regularly defend class-action litigation and have enjoyed great success defeating attempts to have class actions certified. Attorneys in the commercial litigation practice have substantial experience in whistle-blower actions throughout the United States and have defended medical centers and other companies in civil RICO and federal fraud litigation.
When approaching adjudications, LTT focuses on developing and implementing a consistent strategy with a clear objective and result, rather than mere process and procedure. Ordinarily, before undertaking a litigation project (as either a plaintiff or defendant), LTT’s attorneys map out the projected activity and schedule for litigation, budget each of the necessary tasks, and work with the client to develop a strategic approach consistent with the client’s economic needs, risk profile, and selection of forums and remedies. LTT will work with clients to establish mutually satisfactory budgets consistent with this approach.

LTT’s attorneys have defended attorneys, accountants, actuaries, real estate agents, financial planners, insurance agents, and brokers in both state and federal court litigation as well as before regulatory agencies. The firm acts as monitoring and coverage counsel nationwide and provides general counsel advice to insurance agents and brokers, investment advisers, and financial planners, and acts as monitoring counsel, coverage counsel, and claims counsel for insurers issuing professional liability coverage to insurance agents and brokers. LTT’s attorneys have extensive experience in all aspects of underwriting and claims processes, including issues of agency law, binding authority, cover-holder disputes, surplus lines, and reinsurance issues.
A chief focus of LTT’s professional liability practice is litigating liability claims brought against lawyers. LTT’s attorneys have a proven ability to quickly understand the often-complex matters that are the source of legal malpractice claims as well as an appreciation for the sensitive nature of the attorney-client relationship.
Legal malpractice claims continue to rise the prevalence of high-profile legal malpractice claims and class action litigation directed at attorneys as well as the growing number of plaintiff’s attorneys willing to promote themselves as “legal malpractice specialists” have increased the number of claims against attorneys. LTT’s attorneys have handled numerous class action lawsuits against attorneys. Many of these lawsuits fall under the Fair Debt Collection Practices Act. LTT’s attorneys are experienced in defending these lawsuits, provide risk management services, and are frequent speakers on these topics.
Fiduciary Liability
LTT represents the interests of insurers in connection with claims made against their insureds (including pension plans, plan fiduciaries and third-party administrators) for alleged violations of the Employee Retirement Income Security Act of 1974. LTT’s attorneys have experience with various types of these complex and increasing claims, from “tag-along” actions, which accompany securities fraud class actions and allege breach of fiduciary duty, to complaints alleging ERISA violations in connection with the conversion of traditional defined benefit pension plans to “cash balance” plans.

Financial Services
LTT’s attorneys are recognized leaders in representation of the financial services industry. They have defended clients in numerous securities fraud cases involving a wide range of issues from “suitability” cases to fraud claims under state and federal securities laws.
